Terms of sale

1. General provisions

The kengur.ee online store (hereinafter — the online store) is owned by VT-TECH OÜ, registration code 17235457, address: Põllu põik 7-1, Tallinn, e-mail: kengur.est@gmail.com. Communication with the online store takes place by e-mail.

The online store has no point of sale and no pick-up point: goods are sold and delivered remotely.

These terms of sale (hereinafter — the terms) apply to purchases of goods in the online store. By making a purchase, the buyer confirms that they have read the terms and accepts them.

2. Prices and product information

All prices for goods sold in the online store are shown in euros and include value added tax (VAT). Prices are shown next to the product.

Product information (including the condition of a used item) is provided in the online store directly next to the product. The condition of used equipment is indicated by a label (Uus / A+ / A / B / C), the meaning of which is explained next to the product and on the “Withdrawal and return” page. A brief explanation:

Label Meaning
Uus A new, unused item.
A+ Like new — no signs of use, or they are barely noticeable.
A Very good condition — minor signs of use.
B Good condition — visible signs of use (scratches, small dents).
C Heavily used — pronounced signs of use (scratches, dents).

The condition rating describes the appearance of the goods and does not replace the description of the specific unit. Goods are sold functional unless the product description states otherwise: any deviation in operation (for example, a non-working USB port or webcam) is listed in the description of that unit. Purchasing a product with a deviation stated in the description means that the buyer was informed of it before concluding the contract and accepted the goods in that condition (see sections 6 and 7).

3. Placing an order and payment

To order goods, add the selected items to the cart, fill in the required fields and choose a suitable delivery method. The amount to be paid is then displayed, and can be paid using one of the methods offered at checkout. Settlements for all payment methods are made in euros.

The specific payment methods are shown at checkout and may change. The personal data needed to carry out the payment is transmitted to the authorised processor (the payment intermediary); its name is stated in the Privacy Policy.

The contract of sale between the buyer and the online store (hereinafter — the contract) is concluded by placing an order in the online store and is considered concluded from the moment the order is paid for in full.

If the ordered goods cannot be supplied (for example, the item is out of stock), the buyer is notified at the first opportunity and the money paid (including the delivery cost) is refunded immediately, but no later than 14 days from the date the notification was sent.

4. Delivery

Goods are shipped only within Estonia.

The order is assembled and handed over to the carrier, as a rule, within 1–3 working days of the payment arriving. Within Estonia, the parcel usually reaches the pick-up point, parcel locker or address indicated by the buyer within 2–3 working days of being handed to the carrier. In exceptional cases, the online store has the right to deliver the goods within a period of up to 30 calendar days.

The exact delivery cost depends on the chosen method and is shown at checkout — before the order is confirmed. Delivery to a parcel locker/pick-up point is free for orders from 59 €; courier delivery is charged regardless of the order amount.

5. Right of withdrawal

After receiving the goods, the consumer (a natural person) has the right to withdraw from the contract within 14 days. The 14-day period begins to run from the day the consumer received the goods.

To exercise the 14-day right of withdrawal, the goods may be used only to the extent necessary to check their properties, characteristics and functioning — as is permitted when examining the goods in an ordinary shop. If the goods have been used beyond what is necessary for checking them, or show signs of use or wear, the online store has the right to reduce the amount refunded in proportion to the decrease in the value of the goods.

The withdrawal notice is submitted electronically to the e-mail address kengur.est@gmail.com; it states the buyer’s name, the order number and the goods being returned. The online store confirms receipt of the notice electronically, noting the goods being returned and the date of withdrawal.

The right of withdrawal does not apply to goods made to the buyer’s custom order, or to other goods listed in the law.

The cost of returning the goods is borne by the buyer, except where the returned goods do not match those ordered or have a defect for which the online store is liable (for example, wrong or defective goods, or goods with a defect not stated in their description). The goods are returned as a parcel — via a parcel locker, a parcel point or a postal service; handing the goods over in person is not provided for. The online store communicates the return address and method in the confirmation of receipt of the withdrawal notice. The buyer must return the goods within 14 days of submitting the withdrawal notice, or provide proof that they handed the goods over to the carrier within that period.

The online store refunds to the buyer the amounts received under the contract, including the cost of delivering the goods, immediately, but no later than 14 days from receipt of the withdrawal notice. The online store may withhold the refund until it has received the goods back or proof of their dispatch. The refund is made using the same payment method the buyer used to pay for the order, unless the buyer has expressly agreed to another method. If the buyer chose a delivery method more expensive than the cheapest standard method, the difference in cost is not refunded; if the order qualified for free delivery, the delivery cost to be refunded is 0 €.

If the price of a product in the online store is, due to an error, significantly lower than the market price, the online store has the right to rescind the transaction and reclaim the goods.

6. Right to submit a claim (defects)

The online store is liable for any non-conformity of the goods with the terms of the contract, as well as for defects that already existed at the time the goods were handed over and became apparent within two years of the goods being handed over to the buyer. If a defect is discovered within the first 12 months after the goods were handed over, it is presumed to have existed at the time of hand-over; the online store must rebut this presumption (that is, prove that the defect arose through the buyer’s fault).

The online store is not liable for a non-conformity or defect about which the buyer was informed before concluding the contract and which was separately indicated in the description of the specific unit’s condition (scratches, signs of repair, deviations in the operation of individual ports, the camera, the battery, etc. listed in the product card). Purchasing such goods means the buyer agrees to the deviations indicated. This does not limit the right of withdrawal under section 5: the goods can be returned within 14 days, but the buyer bears the cost of return.

The online store is not liable for defects that arose after the goods were handed over to the buyer, including due to improper use, mechanical damage or the ingress of liquids.

The buyer has the right to contact the online store no later than two months after discovering the defect, by sending an e-mail to kengur.est@gmail.com.

If a defect for which the online store is liable is discovered in the goods, the online store repairs the defect or replaces the goods. If the goods can be neither repaired nor replaced, the online store refunds to the buyer all amounts received under the contract.

The online store responds to a consumer’s complaint in writing, or in a form that allows it to be reproduced in writing, within 15 days.

7. Seller’s warranty

In addition to the rights arising from the law (section 6), the online store provides a voluntary seller’s warranty. For used equipment, its term is at least 12 months; for other goods, a warranty is provided if its term is stated next to the product. The seller’s warranty does not limit the buyer’s statutory rights.

Under the warranty, the online store remedies the defect in the goods or replaces the goods with an equivalent item. If the goods are replaced during the warranty period, a new warranty of the same duration is provided for the replacement item. A warranty claim is submitted by e-mail to kengur.est@gmail.com; the device is handed over as a parcel — via a parcel locker, a parcel point or a postal service; handing it over in person is not provided for. The online store communicates the address and method of hand-over in response to the claim.

If the warranty case is confirmed, the cost of shipping the device is borne by the online store; if the defect is not confirmed or falls under the exceptions listed below, the cost of transport is borne by the buyer. This rule does not affect the buyer’s rights under section 6: the cost of remedying a defect for which the online store is liable by law is borne by the online store.

The seller’s warranty does not cover:

  • defects and deviations stated in the description of the specific unit’s condition at the time of sale;
  • natural wear, including the gradual reduction in battery life — the battery condition stated in the product description at the time of sale is taken as the starting point (the measured runtime, and, where the device reports them, the capacity in percent or the number of cycles). At the same time, complete battery failure (it does not charge, is not detected by the system, or has swollen) is a warranty case;
  • mechanical damage: impacts, drops, cracks, chips, dents, as well as the ingress of liquids or foreign objects and the corrosion they cause;
  • damage arising from use other than intended, failure to follow the instructions, overheating, voltage fluctuations, or unsuitable chargers and power supplies;
  • self-repair or opening of the device, modification of its configuration, as well as damaged, altered or removed serial numbers and seals;
  • software errors, viruses, software and operating system settings;
  • the preservation of data on storage media — please save important information elsewhere before handing the device over for warranty repair.

8. Processing of personal data

The online store processes the buyer’s personal data for the processing of the order and delivery of the goods in accordance with the Privacy Policy.

9. Dispute resolution

Claims against the online store should be sent by e-mail to kengur.est@gmail.com.

If the buyer and the online store cannot settle the dispute by agreement, the buyer has the right to turn to the Consumer Disputes Committee (up-to-date information and the application: ttja.ee). The Committee resolves disputes arising from the contract. Consideration of a complaint in the Committee is free of charge for the buyer.

The buyer may also turn to the EU dispute resolution platform (ODR).
